Commercial buildings of 10,000 sq. ft. or more gross floor area must mitigate the demand for affordable housing. It is strongly preferred that projects provide BMR housing units on-site (if allowed by zoning), or off-site, if on-site is infeasible. If not possible to provide on-site or off-site units, developers shall pay in lieu fees into the BMR housing fund to support affordable housing.
Residential developments of five or more units are subject to the requirements of the BMR housing program. These requirements also apply to condominium conversions of five units or more. As part of the application for a residential development of five or more units, the developer must submit a BMR housing agreement.
The U.S. Department of Housing and Urban Development establishes income limits based on the Area Median Income (AMI) for each county in each state. For a family to be eligible for federal housing assistance in San Mateo County, the total household income must not exceed the established yearly income limits.
