City Council to consider updated tobacco retailer ordinance

On Jan. 23, the Menlo Park City Council will conduct the first reading and introduce an ordinance which aims to repeal and replace Chapter 5.26 by updating regulations for tobacco retailers by reference of Chapter 4.98 from the San Mateo County Code of Ordinances. The proposed changes include consolidating definitions, adding permitting requirements and designating County of San Mateo to administer the ordinance on behalf of Menlo Park.

The proposed amendments clarify the County of San Mateo's authority concerning tobacco retailer operations within incorporated areas. The amendments also grant cities the option to maintain the County's authority for the uniform administration of tobacco retailer operations regulations across the entire county on behalf of cities. This is achieved by permitting cities to adopt the County's updated Tobacco Retailer Permit Ordinance by reference. The City Council plans to hold the second reading Feb. 13.
