The Community Development Director has administratively acted upon the following administrative permit application:

Administrative Permit/Steve Rawlings/4200 Bohannon Drive:
Request for an administrative permit for outdoor seating associated with a full service restaurant, and administrative permits for Type 41 and 52 ABC licenses for on-site beer and wine sales and consumption and ancillary catering license associated with a full-service restaurant (including outdoor seating area) at 4200 Bohannon Drive in the O (Office) zoning district.

Per Section 16.82.440 of the Zoning Ordinance, staff has considered various factors, including any comments received in response to the request, the nature and condition of all adjacent uses and structures, the impact of the application on the area in question, and whether a public convenience or necessity would be served by the issuance of a license to sell beer and wine. Staff has determined that the proposed on-site sale of beer and wine, in conjunction with a restaurant, including outdoor seating, is appropriate and would not be detrimental to the health, safety, morals, comfort, or general welfare of the persons residing or working in the neighborhood. This action is supported by the following factors:

  • The proposal has been reviewed by the Menlo Park Police Department, which does not have any project-specific concerns.
  • The alcohol license would be consistent with similar office campus restaurant uses, would provide a public convenience, and would also permit the restaurant to serve beer and wine.
  • The outdoor seating would maintain unimpeded pedestrian access on the public right-of-way.
  • Staff did not receive any correspondence or calls in opposition of the request.

ACTION: Approved subject to the following conditions:

  • Any citation or notification of violation by the ABC will be grounds for considering revocation of the administrative permit.
  • Proposed on-campus catering is considered an ancillary use to the approved café and catering shall be restricted to on-campus locations only.

The appeal period for this action has been set from March 6, 2024 through March 21, 2024. Any interested persons may appeal to the Planning Commission any decision of the Community Development Director and may appeal to the City Council any decision of the Planning Commission regarding administrative approvals. All appeals must be made in writing and filed with the Community Development Department within the above appeal period, and must clearly state the reason for the appeal. A fee, as set by the City Council, shall also accompany the appeal. Upon receipt of an appeal, the Community Development Director shall set a time for a public hearing on such appeal. Appeals to the City Council are governed by Chapter 16.86.020.
