104 Constitution Dr.

The City has received a formal development application for 104 Constitution Drive which asserts to have been filed under the so-called “builder’s remedy.” 

  • 140 residential units (density: 160 du/acre)
  • 151,000 square feet (approximately 3.96 FAR)
  • Height: Approximately 83 feet to the roof deck and 92 feet, four inches to the top of the elevator and stairwell shafts

The proposed multi-family residential building would be located on a portion of a site which the City approved in 2022 for development of a 34,499 square foot office and commercial building (the approval was part of the Menlo Portal project, now known as Vasara, which included a 335 unit multi-family building that is nearing initial occupancy, and the commercial building, construction of which has not yet commenced).

The development data for this application will be verified once the application has been deemed complete. 

What are the next steps?

The City received a formal development application on June 4, 2024. In order to be deemed complete by the City, the application must include all submittal items required by the City. Staff will review whether the application is complete within 30 days of receipt of the application. Once the application is deemed complete by the City, the City will begin reviewing the application for compliance with applicable development standards and City requirements. 

City staff will review the application for completeness and convey its completeness determination on the application by July 4, 2024.

Are the project plans available for review?

Pursuant to State law, the City is limited in its availability to publicly post architectural drawings without architect permission. Members of the public may view the application materials, including architectural drawings, in person at City Hall. Appointments are encouraged to view the materials in person. Appointments with the Planning Division can be made online at menlopark.gov/appointment.
