Repair responsibility - Local ordinance

Municipal Code Chapter 13.08 requires that adjacent property owners keep their sidewalks in good repair and safe for public travel. This means that private property owners are responsible for repairing sidewalks when damaged and keeping them clear from vegetation overgrowth.

However, when a City street tree causes sidewalk damage, the City completes the required repairs. This is part of the sidewalk repair program funded through the landscaping assessment district.

Eliminating the hazard

When sidewalk tripping hazards are reported to the City, staff make temporary repairs to reduce the immediate hazard. A notice is then sent to the property owner requiring that the sidewalk be permanently repaired.  

For sidewalk damage caused by City trees, staff make temporary repairs. Permanent repairs are then added to a list and completed based on an annual work plan.

Annual work plan

Each fiscal year, the City shaves down (saw cuts) a portion of the sidewalks damaged by City trees in different areas as shown in the table below.
