The City is required to comply with the National Pollutant Discharge Elimination System (NDPES) Stormwater Discharge Permit and prevent the pollution of waterways and San Francisco Bay. Pollution sources include illegal discharges, dumping of waste, hazardous waste spills, sewage, and construction debris. When pollution enters the City's storm drain system through catch basins, it is conveyed to waterways and San Francisco Bay. The City is required to work with residents, developers, and the general public to prevent pollution from entering the stormwater system to protect water quality and public health. Specific requirements are found in the Municipal Regional Permit of the NPDES and in Menlo Park Municipal Code 7.42.

On construction projects, developers are required to reduce the quantity and improve the quality of stormwater that flows into the City’s storm drain system from private property. Depending on the size of the project, the City may require specific practices or treatment systems to minimize pollutants from entering the City's storm drain system. For larger projects, an agreement to install and maintain stormwater treatment measures is also required.
