The Sobrato Organization has submitted a request for a use permit, architectural control, below market rate housing agreement, community amenities agreement, heritage tree removal permit, environmental review, and density bonus to redevelop five parcels with approximately 116 townhomes and 316 apartments (for 432 dwelling units total) on a 8.15 acre site located at 119-127 Independence Drive, 1205 Chrysler Drive and 130 Constitution Drive. The overall proposal would be comprised of:

  • 476,962 square feet of total gross floor area
  • An average height of 48.75 feet and a maximum height of 67 feet
  • 66 below market rate housing units (15% of the total 432 units)
  • 586 parking spaces, including tandem and guest parking spaces
  • 75,312 square feet must be publicly accessible open space
  • 135,387 square feet of total open space

City staff is evaluating the project proposal to refine the review process, tentative project schedule, required land use entitlements, and the appropriate environmental review. It is anticipated that the following land use entitlements would be applicable to the proposed project:

  • Environmental review
  • Use permit
  • Architectural control
  • Major subdivision
  • Below market rate housing agreement
  • Community amenities agreement
  • Heritage tree removal permit

Current status

On Nov. 28, 2022, the city released the notice of availability(PDF, 201KB) for the draft environmental impact report(PDF, 22MB) prepared for the project as part of the environmental review process and identified that an environmental impact report will be required. The public comment period begins Monday, Nov. 28, 2022, and ends Tuesday, Jan. 17, 2023. On Dec. 12, 2022, the Planning Commission will hold a public hearing to solicit comments on the Draft EIR and provide feedback on the project design. Once the Draft EIR comment period is completed, staff will review and respond to all substantive comments received in what is referred to as a “Response to Comments” document or Final EIR.

On Nov. 28, 2022, the City released the notice of availability(PDF, 201KB) for the draft environmental impact report(PDF, 22MB) (Draft EIR) for the proposed 123 Independence Drive development project. The Draft EIR public comments period started Nov. 28, 2022, and ends Jan. 17, 2023. If you would like to submit comments, you are encouraged to do so before 5 p.m., Tuesday, Jan. 17, 2023. Notice of preparation

A notice of preparation was prepared for the proposed project. The City requested comments on the scope and content of the environmental impact report during a 30-day comment period that ended October 11, 2021.
